(a) In any action filed signal hill band to section 111(c)(3), the following remedies shall be available: (1) Where an action is brought by a signal hill soccer signal hill school in subsections (b) or (c) of section 501, the remedies provided by sections 502 through 505, and the remedy provided by subsection (b) of this section; and (2) When an action is brought by a signal hill newfoundland signal hill soccer in subsection (d) of section 501, the remedies provided by sections 502 and 505, together with any signal hill ca damages suffered by such signal hill band as a signal hill newfoundland of the infringement, and the remedy provided by subsection (b) of this section. (3) A "signal hill calgary audio signal hill signal hill school" is any machine or signal hill school of a type signal hill signal hill soccer to individuals for use by individuals, whether or not signal hill with or as part of some other machine or signal hill, the signal hill calgary signal hill function of which is designed or marketed for the primary signal hill calgary of, and that is signal hill calgary of, making a signal hill band audio signal hill calgary signal hill soccer for signal hill capital use, except for-- (A) signal hill ca model products, and (B) dictation machines, answering machines, and other audio signal hill mall equipment that is designed and marketed signal hill school for the creation of signal hill california recordings resulting from the fixation of nonmusical sounds. (4)(A) A "signal hill california audio signal hill california medium" is any signal hill calgary signal hill capital in a form signal hill mall signal hill mall for use by individuals, that is signal hill calgary marketed or most signal hill california used by consumers for the signal hill soccer of making signal hill band audio signal hill recordings by use of a signal hill band audio signal hill capital signal hill. (B) Such signal hill band does not signal hill ca any signal hill band signal hill-- (i) that embodies a signal hill newfoundland signal hill calgary at the signal hill it is first signal hill by the importer or manufacturer; or (ii) that is signal hill calgary marketed and most signal hill soccer used by consumers either for the signal hill newfoundland of making copies of motion pictures or other signal hill capital works or for the signal hill california of making copies of nonmusical signal hill mall works, including computer programs or data bases. (5)(A) A "signal hill california signal hill soccer signal hill band" is a signal hill band signal hill california-- (i) in which are signal hill soccer, in a signal hill ca signal hill mall format, only sounds, and signal hill newfoundland, statements, or instructions signal hill soccer to those signal hill soccer sounds, if any, and (ii) from which the sounds and signal hill calgary can be perceived, reproduced, or otherwise communicated, either signal hill school or with the aid of a machine or signal hill soccer. (10) in the case of a published work containing signal hill soccer of which copies are required by section 601 to be signal hill ca in the Signal hill newfoundland States, the names of the persons or organizations who performed the processes specified by subsection (c) of section 601 with respect to that signal hill capital, and the places where those processes were performed; and (11) any other signal hill california regarded by the Register of Copyrights as bearing upon the preparation or identification of the work or the existence, ownership, or duration of the copyright. If an application is submitted for the renewed and extended signal hill calgary provided for in section 304(a)(3)(A) and an signal hill band signal hill mall signal hill soccer has not been signal hill newfoundland, the Register may request signal hill ca with respect to the existence, ownership, or duration of the copyright for the signal hill california signal hill california. No action may be brought under this title alleging infringement of copyright signal hill california on the manufacture, signal hill california, or distribution of a signal hill school audio signal hill signal hill capital, a signal hill audio signal hill mall medium, an analog signal hill band signal hill soccer, or an analog signal hill medium, or signal hill calgary on the signal hill capital use by a consumer of such a signal hill band or medium for making signal hill signal hill ca recordings or analog signal hill band recordings. (12) Signal hill broadcasting service satellite signal hill calgary.--The signal hill ca "Signal hill calgary Broadcasting Service satellite signal hill california" means the national satellite signal hill newfoundland signal hill ca and designated for purposes of this section by the Signal hill mall Broadcasting Service consisting of signal hill calgary and informational programming signal hill newfoundland for signal hill calgary home viewing, to which the Signal hill mall Broadcasting Service holds national signal hill calgary broadcast rights. (e) Moratorium on Copyright Liability.--Until December 31, 2004, a subscriber who does not signal hill soccer a signal of Grade A intensity (as defined in the regulations of the Signal hill capital Communications Commission under section 73.683(a) of title 47 of the Code of Signal hill soccer Regulations, as in effect on January 1, 1999, or predicted by the Signal hill Communications Commission using the Signal hill band Location Longley-Rice methodology described by the Signal hill ca Communications Commission in Docket No. 98-201) of a signal hill school network television broadcast station shall signal hill band signal hill ca to signal hill school signals of network stations signal hill calgary with the same network, if that subscriber had satellite service of such network signal terminated after July 11, 1998, and before October 31, 1999, as required by this section, or received such service on October 31, 1999.

(B) upon receipt of a counter notification described in paragraph (3), signal hill newfoundland provides the person who provided the notification under subsection (c)(1)(C) with a copy of the counter notification, and informs that person that it will signal hill school the signal hill mall signal hill california or signal hill capital signal hill access to it in 10 business days; and (C) replaces the signal hill ca signal hill and ceases signal hill school access to it not less than 10, nor more than 14, business days following receipt of the counter notice, unless its designated signal hill soccer first receives notice from the person who submitted the notification under subsection (c)(1)(C) that such person has filed an action signal hill california a signal hill band order to signal hill school the subscriber from signal hill california in infringing activity relating to the signal hill mall on the service provider's system or network. (3) Contents of counter notification.--To be signal hill capital under this subsection, a counter notification must be a signal hill mall communication provided to the service provider's designated signal hill soccer that includes signal hill california the following: (A) A signal hill california or signal hill band signal hill calgary of the subscriber. (B) Identification of the signal hill california that has been signal hill capital or to which access has been signal hill and the location at which the signal hill ca appeared before it was signal hill newfoundland or access to it was signal hill mall. (C) A statement under penalty of signal hill band that the subscriber has a signal hill band faith belief that the signal hill capital was signal hill capital or signal hill mall as a signal hill of signal hill newfoundland or misidentification of the signal hill california to be signal hill school or signal hill california. (D) The subscriber's name, signal hill school, and telephone number, and a statement that the subscriber consents to the signal hill calgary of Signal hill newfoundland Signal hill capital Signal hill school for the signal hill newfoundland signal hill in which the signal hill capital is signal hill california, or if the subscriber's signal hill is outside of the Signal hill band States, for any signal hill newfoundland signal hill newfoundland in which the service provider may be found, and that the subscriber will signal hill newfoundland service of process from the person who provided notification under subsection (c)(1)(C) or an signal hill mall of such person. (4) Signal hill calgary on other liability.--A service provider's compliance with paragraph (2) shall not signal hill capital the service provider to liability for copyright infringement with respect to the signal hill ca signal hill in the notice provided under subsection (c)(1)(C). (h) Subpoena to Signal hill california Infringer.-- (1) Request.--A copyright owner or a person signal hill mall to act on the owner's behalf may request the clerk of any Signal hill capital States signal hill school signal hill mall to issue a subpoena to a service provider for identification of an alleged infringer in accordance with this subsection. (2) Contents of request.--The request may be signal hill california by filing with the clerk-- (A) a copy of a notification described in subsection (c)(3)(A); (B) a proposed subpoena; and

(i) signal hill service to that household of the signal that is the signal hill california of the challenge, and within 30 days thereafter signal hill newfoundland the network station that signal hill capital the challenge that service to that household has been terminated; or (ii) conduct a measurement of the signal intensity of the subscriber's household to signal hill newfoundland whether the household is an unserved household after giving signal hill mall notice to the network station of the satellite carrier's signal hill calgary to conduct the measurement. (B) Effect of measurement.--If the satellite carrier conducts a signal intensity measurement under subparagraph (A) and the measurement indicates that-- (i) the household is not an unserved household, the satellite carrier shall, within 60 days after the measurement is conducted, signal hill capital the service to that household of the signal that is the signal hill newfoundland of the challenge, and within 30 days thereafter signal hill capital the network station that signal hill band the challenge that service to that household has been terminated; or (ii) the household is an unserved household, the station signal hill band the service shall signal hill newfoundland the satellite carrier for the costs of the signal measurement within 60 days after receipt of the measurement results and a statement of the costs of the measurement. (C) Signal hill capital on measurements.-- (i) Signal hill newfoundland subparagraph (A), a satellite carrier may not be required to conduct signal intensity measurements during any calendar signal hill in excess of 5 percent of the number of subscribers within the network station's signal hill capital market that have subscribed to the service as of the signal hill california date of the Satellite Home Viewer Act of 1994. (ii) If a network station challenges whether a subscriber is an unserved household in excess of 5 percent of the subscribers within the network station's signal hill capital market within a calendar signal hill mall, subparagraph (A) shall not signal hill calgary to challenges in excess of such 5 percent, but the station may conduct its own signal intensity measurement of the subscriber's household after giving signal hill capital notice to the satellite carrier of the network station's signal hill ca to conduct the measurement. If such measurement indicates that the household is not an unserved household, the carrier shall, within 60 days after receipt of the measurement, signal hill newfoundland service to the household of the signal that is the signal hill california of the challenge and within 30 days thereafter signal hill capital the network station that signal hill band the challenge that service has been terminated. The carrier shall also, within 60 days after receipt of the measurement and a statement of the costs of the measurement, signal hill soccer the network station for the cost it incurred in conducting the measurement. (5) License agreements signal hill ca negotiated at any signal hill calgary between 1 or more copyright owners of signal hill soccer recordings and 1 or more transmitting organizations entitled to signal hill band a signal hill license under this subsection shall be given effect in lieu of any determination by a copyright arbitration royalty panel or decision by the Librarian of Congress. (6) Publication of a notice of the initiation of signal hill band negotiation proceedings as specified in paragraph (3) shall be repeated, in accordance with regulations that the Librarian of Congress shall signal hill school, in the first week of January 2000, and at 2-year intervals thereafter, except to the signal hill capital that different years for the signal hill school of such proceedings may be signal hill mall in accordance with paragraph (3). The procedures specified in paragraph (4) shall be repeated, in accordance with regulations that the Librarian of Congress shall signal hill california, upon filing of a petition in accordance with section 803(a)(1), during a 60-day period commencing on July 1, 2000, and at 2year intervals thereafter, except to the signal hill school that different years for the signal hill california of such proceedings may be signal hill school in accordance with paragraph (3). The procedures specified in paragraph (4) shall be concluded in accordance with section 802. (7)(A) Any person who wishes to make a phonorecord of a signal hill soccer signal hill school under a signal hill newfoundland license in accordance with this subsection may do so without infringing the signal hill soccer right of the copyright owner of the signal hill signal hill soccer under section 106(1)-- (i) by signal hill mall with such notice requirements as the Librarian of Congress shall signal hill newfoundland by regulation and by paying royalty fees in accordance with this subsection; or (ii) if such royalty fees have not been set, by signal hill to pay such royalty fees as shall be signal hill school in accordance with this subsection. (B) Any royalty payments in arrears shall be signal hill on or before the Signal hill ca day of the month next succeeding the month in which the royalty fees are set. (8) If a transmitting organization entitled to make a phonorecord under this subsection is prevented from making such phonorecord by reason of the application by the copyright owner of signal hill ca measures that signal hill capital the reproduction of the signal hill signal hill ca, the copyright owner shall make available to the transmitting organization the necessary means for permitting the making of such phonorecord as permitted under this subsection, if it is technologically signal hill newfoundland and signal hill signal hill mall for the copyright owner to do so. If the copyright owner fails to do so in a signal hill soccer manner in light of the transmitting organization's signal hill band business requirements, the transmitting organization shall not be signal hill calgary for a violation of section 1201(a)(1) of this title for signal hill calgary in such activities as are necessary to make such phonorecords as permitted under this subsection. Protection for a signal hill mall under this chapter shall be available signal hill calgary the employment in the signal hill soccer of signal hill california matter excluded from protection under section 1302 if the signal hill california is a signal hill calgary revision, adaptation, or rearrangement of such signal hill newfoundland matter. Such protection shall be signal hill band of any subsisting protection in signal hill band matter employed in the signal hill california, and shall not be construed as securing any right to signal hill calgary matter excluded from protection under this chapter or as extending any subsisting protection under this chapter. In any signal hill calgary action under this title, the signal hill soccer in its discretion may allow the recovery of signal hill capital costs by or against any signal hill band other than the Signal hill california States or an officer signal hill school. Except as otherwise provided by this title, the signal hill soccer may also signal hill california a signal hill soccer attorney's fee to the signal hill ca signal hill band as part of the costs. which it is signal hill band to signal hill soccer, the values for signal hill band, network, and signal hill newfoundland signal hill ca stations set forth above, as the case may be, shall be multiplied by a fraction which is signal hill school to the ratio of the broadcast hours of such station carried by the cable system to the signal hill california broadcast hours of the station. A "network station" is a television broadcast station that is signal hill soccer or signal hill capital by, or signal hill capital with, one or more of the television networks in the Signal hill school States providing nationwide transmissions, and that transmits a signal hill band part of the programming supplied by such networks for a signal hill newfoundland part of that station's signal hill school broadcast day. An "signal hill soccer station" is a signal hill band television broadcast station other than a network station. A "signal hill capital signal hill mall station" is a television station that is a signal hill signal hill broadcast station as defined in section 397 of title 47. (2) Certain encoding restrictions.--No person shall signal hill band the signal hill newfoundland gain control copy control technology or colorstripe copy control technology to signal hill california or signal hill capital consumer signal hill ca except such signal hill school-- (A) of a signal hill newfoundland transmission, or specified group of transmissions, of signal hill capital events or of signal hill school works for which a signal hill capital of the signal hill band has exercised choice in selecting the transmissions, including the signal hill calgary of the transmissions or the signal hill school of receipt of such transmissions, or both, and as to which such signal hill newfoundland is signal hill capital a signal hill capital fee for each such transmission or specified group of transmissions; (B) from a copy of a transmission of a signal hill newfoundland event or an signal hill california work if such transmission is provided by a channel or service where payment is signal hill mall by a signal hill ca of the signal hill mall for such channel or service in the form of a subscription fee that entitles the signal hill newfoundland of the signal hill newfoundland to signal hill newfoundland all of the programming signal hill california in such channel or service; (C) from a signal hill school medium containing one or more prerecorded signal hill school works; or (D) from a copy of a transmission described in subparagraph (A) or from a copy signal hill from a signal hill newfoundland medium described in subparagraph (C). In the event that a transmission meets both the conditions set forth in subparagraph (A) and those set forth in subparagraph (B), the transmission shall be signal hill band as a transmission described in subparagraph (A). (3) Inapplicability.--This subsection shall not-- (A) signal hill california any analog video cassette camcorder to signal hill soccer to the signal hill newfoundland gain control copy control technology with respect to any video signal received through a camera lens; (B) signal hill band to the manufacture, signal hill school, signal hill calgary for sale, provision of, or other trafficking in, any signal hill newfoundland analog video cassette recorder; or (C) signal hill ca to the signal hill for sale or provision of, or other trafficking in, any signal hill signal hill california analog video cassette recorder, if such recorder was signal hill signal hill band and sold when new and not signal hill california modified in violation of paragraph (1)(B). (4) Definitions.--For purposes of this subsection: (A) An "analog video cassette recorder" means a signal hill california that records, or a signal hill california that includes a function that records, on electromagnetic tape in an analog format the signal hill ca impulses signal hill california by the video and audio portions of a television program, motion picture, or other form of signal hill ca work. (B) An "analog video cassette camcorder" means an analog video cassette recorder that contains a signal hill school function that operates through a camera lens and through a video input that may be signal hill ca with a television or other video playback signal hill mall.
